A demolition permit is a legal document that gives you the right to demolish any structure that requires a building permit to build. But just because a building permit wasn't purchased before construction doesn't mean you don't need a demolition permit.

If the structure was improperly constructed without obtaining a permit, you still have to obtain a permit to demolish it. In New York City, several permits are required for the construction, alteration, or demolition of any building. If you need to perform work or occupy part of the road or trail while doing the demolition, you may also need a road occupancy permit. In general, a planning permit is not required to carry out most demolitions.

However, special rules apply if the building is in a conservation area or is a protected building. Most demolitions will require planning permission. However, you can demolish the items listed below without permission, as long as the structure is within the domestic cutback of your property. It does not include a field or other open land next to a house, even if it is the same property.

However, you will need permission if the structure or building is or forms part of a protected building or site (LBP) or a potential listed building or site (PLBP) or if it is located in a conservation area (CA). In many places, the municipal codes surrounding demolition projects require a delay in demolition under certain circumstances. If you work on more than one structure, you must obtain a separate demolition permit for each one that requires demolition. You can hire just about anyone you want to handle your demolition project, as long as they're a licensed demolition contractor in New York State.

However, keep in mind that if at any point your major alteration project becomes a demolition project in accordance with the provisions of the code, you must stop your project and obtain a demolition permit before continuing the work. Once the site passes the pre-demolition inspection, your demolition contractor submits a work permit (PW) application to the appropriate DOB municipal office to obtain a demolition permit. The delay occurs to ensure that there is time for appropriate notices to be sent by mail and email to the appropriate organizations and, in some cases, for appropriate signs to be placed on properties before the start of the demolition activity.
